Just currious, hypotheitcaly specking IF some1 got pulled over for DUI, Open container, container by feet. refuseing to breathize. and found majarouna seeds in car. what do you think would be the punishment

What Arthur? Found yourself in that situation last night?

Well, the least I would think would be a veeeeeeeeeeeeeeeeerry heavy fine. With maybe some jail time... Would that also include resist arrest? Maybe a few thousand hours of community service...

DUI = Driver's licence suspension w/ community service and a fine
Possesion of Marjiuana = Fine with possible juvenile/jail time in addition to more community service and state run therapy.

Not that I would know anything about either

You'd automatically be arrested for sure. DUI and DWI can sometimes be classified differently and I think in some states (or all? not sure) it's a felony. That's bad, mmkay? Possession of MJ would be the least of your worries at that point. Seriously.

And if you're underage, you'll lose your license for longer and have heavier fines. Refusing a breathalizer - bad. When you have a valid driver's license and are driving a vehicle you are automatically required to submit to a breathalizer if asked. I'm not sure if not doing so would qualify as obstructing justice, but either way you immediately qualify as DU/WI. In mos states, open container isn't that big. Either way, if this hypothetically happened to you, I'd say you're screwed for quite a while.

Each state has their own DUI laws, so that isn't necessarily true of all of them.

Get a lawyer. Refusing breathalizer can be good cos of less evidence against you. I have heard this from more than 1 attorney.

Here in MD you can refuse to take a breathalizer on the spot, but typically your insurance company will drop you. The reason why: the officer can "suspect" you of being intoxicated, and aprehend you on that suspicion, but a field breathalizer is inadmissable in court.

they must breathalize you at the station, so there is a possibility that your BAC gets lowered naturally in the time between the traffic stop and the time at the station.


Outside of that, DUI here is pretty serious. License suspension pending MVA hearing and court trial is immediate, they give you a paper temporary license until the MVA hearing.


Seeds, well, thats a little much. unless it was obvious and given probable cause to search your vehicle (officer see a bong sitting on the back seat, etc) then they really don't have a reason to look that hard. Talk to a lawyer.

o and i forgot to mincon that i told the cop to go Fuck him self. I sayed that i was under 18 so i was not a legal adult. he then asked me to step out of the car and hand cufed me at that point i was pissed. i did no konw that in GA 17 is a legal adult. my bond was 1381 USD. but he droped the dui charge becase i passed a sobraty test in the jail house. i only had 2 beers. but i chuged one as i saw the blue lights of the road stop. so i was not to happy to breathalize. a also luckly the seeds are not enough to get some1 conviected. so im off on that to. only bad thing is that im getting kicked out of school tommrow. i have a meeting with all the top dogs and i will hear what they have to say.

That's lucky he dropped the dui. In Texas, there is a zero tolerance law for minors drinking and driving.

i just talked to an attourney and he said that the arrest was unlawful. and since he did not read me my rights. and since 17 year olds have only been leagl for 2 years now, and i had to sign saying that i was aware of the law change. and he did not ask to search my car. the things i was charged with were all hidden in the car. so all charges are likely to be droped. HAHA. i love america.
now i just have to deal with my school and pray i dont get kicked out. good chance though that i will though.
